Constitutional Council rejects Belaiz proposal
Corruption judiciary poles
Wednesday Jun 20 2007.
Officials in justice sector are striving to set up judiciary poles dedicated to corruption combating, for which magistrates have been sent for training abroad.
Well informed sources wondered about the statute to be adopted by justice minister Mr. Tayeb Belaiz to create those poles after the constitutional council has decided articles 24, 25, and 26 on the creation of corruption judiciary poles of the organic law on judiciary system organization to be unconstitutional.
In this framework, President of the Republic has promulgated the organic law related to the judiciary organization in 2005 without the aforementioned articles abiding by the constitutional council’s decision which is a prescriptive decision for all public, administrative and judiciary authorities, and cannot be reviewed according to article 49 of the Constitutional Council’s rules of procedure.
However, justice ministry proposal still mentions the creation of the judiciary poles which have become an illusion.
