Declared that he sent a complain to the anti-by-default custody committee, that is affiliated to the united nations, as a protestation of the lack of juridical grounds for his arrest from 2005. Amin Sidhoum, the prisoner’s lawyer declared that the complain was sent before yesterday to the committee office in Geneva through the lawyer who is defending him in France, pointing out that the document “protests against the unlawful, and unjustified, administrative arrest of our client, and also it protests against putting his in home arrest for 5 months now without giving the place where he is being arrested nor the period of this arrest”. The interior minister, Yazid Zerhouni, had signed the decision of Benyamina arrest on 14 September 2005, on the ground of a bill stipulating emergency state. This took place after one month of his arrest in Oran airport while he was going back to Paris. The same source declared, in a communication, that “we don’t know the juridical situation of Ben Yamina imprisonment, is he in temporary custody? ...there is besides no sign of his file neither at the judge’s office nor at the accusation chamber”. The committee of anti-by-fault custody of the UN is expected to correspond with the Algerian authorities after the study of the complaint, knowing that Algeria was elected as a member in the human rights council that is affiliated to the united union last month, and signed international agreements in human rights field including the agreement of civilian and political rights. El Khabar has been told from well informed sources that the authorities expect that the French judge John Louis Bruguière, who is specialised in terrorism, would go to Algeria in order to question Benyamina. Bruguière presides counter-terrorism cell in Paris that is investigating in the case of four persons accused of the preparation to attack the intelligence building and Orly airport and metro of Paris. The name of Benyamina was mentioned by one of them during the questioning. The lawyer Sidhoum informed that a delegation from the international committee of the Red Cross has visited Benyamina in his prison in Bouira last week and listened to him concerning his imprisonment conditions. The prisoner was transferred from Serkagi to Bouira after his re-arrest for causes that were a subject of controversies from different declarations of justice and interior ministers. H.
